Treaty Investor

A treaty investor is a foreign national who qualifies for E-2 visa status by investing capital in a US business and actively directing its operations. The investor must own at least 50% of the enterprise or have operational control through a managerial position. Passive investors — those who simply put money into a business without involvement — do not qualify. The investor must be a citizen of a treaty country and physically present in the US to manage the business.
