EB-5 Investment Amount: Current Requirements, TEA Rules, and What It Actually Costs

The EB-5 Immigrant Investor Program offers a direct path to a U.S. green card through investment. As of the EB-5 Reform and Integrity Act of 2022, the minimum investment amount is $1,050,000 for standard projects and $800,000 for projects in Targeted Employment Areas. But the actual cost of an EB-5 application goes well beyond the investment itself.

This guide breaks down every dollar you will spend, explains how TEA designation works, and helps you understand the true total cost of obtaining a green card through EB-5.

Current EB-5 Minimum Investment Amounts

The standard minimum investment is $1,050,000. This applies to direct investments and regional center projects that are not located in Targeted Employment Areas.

The reduced minimum is $800,000 for investments in a TEA, which includes rural areas with populations under 20,000 and urban areas with unemployment rates at least 150% of the national average. Most regional center projects qualify for the TEA rate.

These amounts were set by the EB-5 Reform and Integrity Act signed in March 2022. Before that reform, the amounts were $1,000,000 and $500,000 respectively. The investment amounts now adjust automatically every five years based on the Consumer Price Index, with the next adjustment expected in 2027.

What Counts as a Qualifying Investment

The investment must be at risk. This means your capital must be genuinely subject to gain or loss. Guaranteed returns, loan-back arrangements, or redemption agreements that eliminate risk will disqualify the investment.

Acceptable sources of funds include personal savings, property sales, business income, gifts, and inheritance. Each source must be documented with a detailed trail showing the lawful origin of every dollar. This documentation requirement is one of the most challenging parts of the EB-5 process.

You can use borrowed funds, but the loan must be secured by your own assets, not by the EB-5 project. Personal property, real estate, or business assets can serve as collateral.

The full investment amount must be committed before your I-526E petition is filed. Partial investments or installment plans are not accepted by USCIS.

Total Cost Beyond the Investment Amount

Regional center administrative fees range from $50,000 to $80,000. These are one-time fees charged by the regional center to cover project management and investor services. They are separate from and in addition to the investment amount.

Immigration attorney fees for the full EB-5 process range from $25,000 to $50,000. This covers I-526E petition preparation, source of funds documentation, I-829 petition for removing conditions, and ongoing case management over 5 to 7 years.

Source of funds documentation often requires a forensic accountant or financial auditor, costing $5,000 to $20,000 depending on the complexity of your financial history.

For a TEA regional center investment, the realistic total cost is: $800,000 investment plus $60,000 admin fee plus $35,000 legal fees plus $10,000 documentation costs, totaling approximately $905,000. For a standard investment: approximately $1,155,000 all in.

How TEA Designation Works

Targeted Employment Areas are designated by individual states, not by USCIS. Each state has its own process for certifying whether a project location qualifies as a TEA.

Rural TEAs are areas outside any city or town with a population of 20,000 or more. These are straightforward to verify using census data.

High-unemployment TEAs require the area to have an unemployment rate at least 150% of the national average. States can use different geographic boundaries to calculate this rate, which is why some projects in seemingly prosperous urban areas still qualify.

The EB-5 Reform Act created a new category for infrastructure projects, which may qualify for the reduced investment amount regardless of location. These projects are still relatively new and evolving.

Verify TEA designation independently. Some regional centers claim TEA status that may not hold up under USCIS scrutiny. Request the state TEA certification letter and have your attorney confirm its validity.

Direct Investment vs. Regional Center: Which Costs More

Direct investment requires the full $800,000 or $1,050,000 but eliminates the administrative fee. However, you take on all the responsibility for creating 10 full-time jobs and managing the business. Legal fees for direct investments are typically higher, ranging from $40,000 to $75,000.

Regional center investment adds the administrative fee but removes the burden of direct job creation. The regional center handles job creation through economic modeling, which USCIS accepts for indirect job calculations.

Most EB-5 investors choose regional centers despite the higher total cost. The reduced complexity, professional management, and established USCIS track record make regional centers the lower-risk option for most applicants.

If you are an experienced business operator and plan to actively manage a U.S. company, direct investment may make sense. You keep full control of your capital and business, and the total out-of-pocket cost can be lower. But the visa risk is higher if job creation targets are not met.

The EB-5 investment amount is $800,000 or $1,050,000, but the true cost is 10 to 15 percent higher when you account for legal, administrative, and documentation expenses. Budget accordingly and ensure your source of funds documentation is thorough before you begin.
