What is the EB-5 Visa?

The EB-5 Immigrant Investor Program provides a path to U.S. permanent residency for foreign investors who make a qualifying investment in a U.S. commercial enterprise that creates at least 10 full-time jobs for U.S. workers. The standard investment amount is $1,050,000, or $800,000 if investing in a Targeted Employment Area (TEA).

Eligibility Requirements

Investment of $1,050,000 (standard) or $800,000 (TEA)
Investment in a new commercial enterprise
Create or preserve at least 10 full-time jobs for U.S. workers
Capital must be lawfully obtained
Investor must be actively involved in management or policy-making

Application Process

Select an EB-5 project (direct or regional center)

Make the qualifying investment

File Form I-526E petition with USCIS

Upon approval, apply for immigrant visa or adjust status

Receive conditional Green Card (2-year)

File Form I-829 to remove conditions

Duration of Stay

Permanent residency (conditional for first 2 years)
