Notice of Intent to Deny (NOID)

A NOID is a formal USCIS notice indicating the agency has reviewed the case and intends to deny it, but is giving the applicant one final opportunity to respond. This is more serious than an RFE. The applicant typically has 30 days to submit a rebuttal with additional evidence. NOIDs often cite fundamental eligibility concerns — for example, questioning whether the E-2 business is marginal or whether an O-1 applicant meets the extraordinary ability standard. A well-prepared response with strong evidence can sometimes reverse the intended denial.
