EB-1 Extraordinary Ability Visa: Qualifications, Evidence, and Application Guide

The EB-1A category, also known as the Extraordinary Ability green card, is reserved for individuals who have demonstrated extraordinary ability in the sciences, arts, education, business, or athletics. It is one of the fastest paths to a U.S. green card and does not require an employer sponsor or labor certification.

Who Qualifies for EB-1A?

EB-1A is for individuals at the very top of their field. USCIS evaluates applicants based on sustained national or international acclaim. The applicant must show that they intend to continue working in their area of extraordinary ability in the United States.

This category is not limited to Nobel Prize winners or Olympic athletes. Successful EB-1A petitioners include researchers, engineers, business executives, artists, musicians, chefs, and entrepreneurs who can demonstrate significant achievements and recognition.

The 10 Criteria for Extraordinary Ability

USCIS uses 10 criteria to evaluate EB-1A petitions. An applicant must meet at least 3 of these 10 criteria: (1) Receipt of nationally or internationally recognized prizes or awards, (2) Membership in associations that require outstanding achievements, (3) Published material about the applicant in professional or major media, (4) Judging the work of others in the field.

Additional criteria include: (5) Original contributions of major significance, (6) Authorship of scholarly articles, (7) Display of work at artistic exhibitions, (8) Leading or critical role in distinguished organizations, (9) High salary or remuneration relative to others in the field, (10) Commercial successes in the performing arts.

Building a Strong EB-1A Petition

Meeting 3 criteria is necessary but not sufficient. USCIS applies a two-part analysis: first, they determine if the criteria are met, then they evaluate the totality of evidence to determine if the applicant truly has extraordinary ability. Strong petitions include detailed expert letters, extensive documentation, and a compelling narrative.

Expert recommendation letters should come from recognized leaders in the field who can speak specifically to the applicant's contributions and standing. Generic letters of recommendation carry little weight. Each letter should address specific achievements and their impact.

Processing Time and Premium Processing

EB-1A petitions can be filed with premium processing, which guarantees a response within 15 business days for an additional fee of $2,805. Standard processing times vary but typically range from 6 to 12 months. Since EB-1A is a first-preference category, visa numbers are usually immediately available.

The self-petition nature of EB-1A means no employer is needed. The applicant files Form I-140 directly. If already in the U.S., concurrent I-485 filing may be possible, allowing the applicant to receive work authorization while waiting.

Common Reasons for EB-1A Denial

Common denial reasons include insufficient evidence of sustained acclaim, weak or generic recommendation letters, failure to demonstrate that achievements are nationally or internationally recognized rather than local, and inability to show the applicant will continue in the field in the U.S.
