When an EB-5 investor's I-526E petition is approved, they receive conditional permanent residence — a green card valid for 2 years. During this period, the investor has the same rights as any permanent resident (work, travel, live anywhere in the US) but must file Form I-829 before the card expires to remove conditions. If the I-829 is not filed or is denied, the investor may lose permanent resident status. The conditional period begins on the date of admission to the US or approval of adjustment of status.
