La FATCA oblige les institutions financières étrangères à identifier et déclarer les comptes détenus par des personnes américaines à l'IRS. Les contribuables américains ayant des actifs financiers étrangers dépassant certains seuils doivent également déclarer ces actifs sur le formulaire 8938 annexé à leur déclaration fiscale. La loi vise à prévenir l'évasion fiscale par le biais de comptes et entités étrangers.
