E-2 비자 신청자는 투자 기업을 '지휘하고 관리(direct and develop)'하는 위치에 있어야 합니다. 50% 이상의 지분 보유 또는 경영상의 지배권이 요구되며, 단순 직원이나 수동적 투자자는 요건을 충족하지 못합니다.
