Le formulaire I-140 est généralement déposé par un employeur américain pour le compte d'un travailleur étranger, bien que les catégories EB-1A et EB-2 NIW permettent l'auto-pétition. Une fois approuvé, l'I-140 établit la date de priorité du bénéficiaire pour la résidence permanente.
