Contrairement aux investissements via des centres régionaux, l'investissement direct EB-5 exige que l'investisseur joue un rôle actif dans la gestion de l'entreprise. Seuls les emplois directs créés pour des travailleurs américains peuvent être comptabilisés pour respecter l'exigence de dix emplois. Cette voie est plus complexe mais donne à l'investisseur un contrôle total sur son investissement.
