Bien que le visa E-2 exige généralement que l'investisseur dirige activement l'entreprise, il est possible dans certains cas de déléguer la gestion opérationnelle à des directeurs employés. Le demandeur doit néanmoins démontrer qu'il maintient le contrôle de l'entreprise et prend les décisions stratégiques importantes. Cette configuration est plus difficile à approuver et nécessite une documentation solide.
