Une entreprise réelle et active ne doit pas être une simple société holding sans activité opérationnelle réelle. Elle doit fournir des biens ou des services sur le marché et générer des revenus. L'USCIS vérifie que l'entreprise n'est pas un investissement passif tel qu'un terrain non aménagé ou une propriété non utilisée.
