Die USCIS prüft sorgfältig, ob ein E-2-Unternehmen tatsächlich aktiv am Markt teilnimmt. Das Unternehmen muss Mitarbeiter beschäftigen, Kunden bedienen oder Waren produzieren. Reine Anlagegesellschaften oder Immobilienholdings ohne operatives Geschäft qualifizieren sich in der Regel nicht für das E-2-Visum.
